Order, payment and service terms
Final Expense Marketing Terms of Service
Last updated
These terms apply to every order of final expense leads, live transfers, preset appointments and marketing services from Final Expense Marketing. They cover minimums, prepayment, delivery, replacements and credits, limits on liability, and your duties as the business that contacts every prospect.
In short
- Prepaid orders, with 2% off for ACH
- No contract on any lead product; 90-day initial term on managed advertising
- Defects claimed within 72 hours are replaced or credited
- If we cannot fulfil the order, unused lead credit is refundable
Who these terms apply to
These terms of service are an agreement between you and the business that operates Final Expense Marketing ("we", "us"). They apply when you request a quote, place an order or use one of our services, and they include our lead replacement and credit policy, summarized below.
Our products and services are for business buyers only: licensed insurance agents, agencies and call centers buying for their own final expense insurance sales. By ordering, you confirm that you, or the agents who will work each lead, transfer or appointment, hold the licenses and carrier appointments required in each state you order, and that you may accept these terms for the business you order for.
Your order confirmation states what you ordered. Prices are those on the published rate card, or in your quote for a product the rate card does not price, such as Facebook-sourced, telemarketing or shared leads.
Products, minimums and commitments
Each product has its own unit and minimum order. A minimum is an order size, not a term commitment: no lead, transfer or appointment order commits you to buy again.
| Product or service | What you pay for | Minimum order | Term commitment |
|---|---|---|---|
| Exclusive leads | Each lead delivered, one buyer per record | $2,500 to launch: $500 build, $2,000 in leads | None |
| Aged leads | Each record in a segment of one state and one age band; not exclusive | Sold by segment, no minimum spend | None |
| Interest-verified live transfers | Each transfer that meets the five billing rules | $3,000 to launch | None |
| Pre-vetted live transfers | Each transfer that meets the five billing rules, priced by tier | Stated in your quote | None |
| Preset appointments | Each confirmed appointment, or each kept appointment at the kept price | 5 appointments or $1,250, whichever is higher | None |
| Managed advertising | A setup fee, then monthly management; you pay ad spend to the platform | $2,000 a month in ad spend | 90-day initial term |
| Appointment setter desk | A monthly seat that follows up leads you supply | One month, paid before the month starts | No initial term |
Exclusive means one buyer per record: an exclusive lead is delivered to one buyer. It does not reserve a territory. Territory exclusivity is a separate paid reservation, at $500 a month plus your lead purchases. Aged leads are not exclusive unless they have genuinely never been resold.
On pre-vetted transfers, screeners ask health and medication questions to estimate a likely product tier. The carrier makes every underwriting decision.
Prepayment and payment terms
Orders are paid in advance, on these terms:
- All lead packs are prepaid.
- All campaign launch fees are prepaid.
- Monthly services are paid before the service month.
- ACH payments receive a 2% discount.
- No visible card surcharge (processing is built into pricing).
- No net-30 for new buyers.
After 3 successful prepaid cycles, agencies spending $10,000 or more a month may be offered weekly invoicing against an approved credit limit. Prepaying one order is not a commitment to place another.
Delivery: built to order
Fresh exclusive leads and live transfers are generated on demand for your states. No inventory of fresh leads exists, so every fresh order starts with a campaign build. Delivery runs on two clocks. The ramp runs from your paid order: first leads within days, full volume in 2–4 weeks. Latency is the time a lead takes to reach your CRM: seconds after the consumer submits the form. Aged segments are delivered immediately on purchase.
The steps from quote to first delivery are set out in how an order moves from quote to delivery.
Replacements, credits and refunds
Our lead replacement and credit policy is part of these terms and sets out each rule in full, including how to file a claim. In summary:
- A lead with an objective defect, claimed within 72 hours, is replaced or credited. Where your order confirmation states a different claim window, the order confirmation controls.
- Remedy for a defect: Replacement or account credit, not a cash refund.
- A live transfer is billable only when all five billing rules hold, including a connection of at least 90 seconds with a prospect who confirms interest and meets your filters. A prospect who does not buy does not make a billable transfer refundable.
- A confirmed appointment that no-shows gets one free rebooking attempt, and one the prospect denies ever agreeing to is replaced. No-shows are not refunded automatically.
- Prepaid funds are non-refundable after campaign launch.
- If we cannot fulfil the order, unused lead credit is refundable.
Outcomes are not defects. No answer, no interest, no sale, a declined application, a lapse or a carrier chargeback does not earn a replacement, a credit or a refund.
Managed advertising and the setter desk
Managed final expense advertising carries a 90-day initial term, the only initial term on anything we sell. It costs $1,000 to set up, then $1,250 a month or 20% of ad spend, whichever is greater, billed before each service month. You pay the advertising platform directly, with at least $2,000 a month in ad spend, and you own the funnel, pixels and data. The service does not include:
- Guaranteed cost per lead
- Guaranteed volume
- Appointment setting
- A dedicated caller
- Unlimited new funnels or states
Setter-desk seats are monthly services with no initial term, paid before each service month. Seat prices exclude the cost of leads. The desk follows up the leads you supply on a defined attempt schedule and does not promise a number of appointments.
Your compliance duties
You decide how, when and whether to contact each prospect, and you are responsible for that contact. When you buy from us, you agree to:
- Hold the licenses and carrier appointments required in each state where you contact or sell to a prospect.
- Follow every law that governs your calls, texts and emails, including the Telephone Consumer Protection Act and the FCC's rules under it (47 CFR 64.1200), state telemarketing, do-not-call and insurance laws, and the CAN-SPAM Act.
- Check numbers against the National Do Not Call Registry and your own do-not-call list before you call, and add anyone who asks not to be called to your list.
- Call only within permitted hours. Federal rules bar telephone solicitations before 8 a.m. or after 9 p.m. at the consumer's location, and some states are stricter: Florida bars commercial telephone solicitation calls after 8 p.m. in the called person's time zone.
- Honor every request to stop calls or texts. Under the FCC's rules, a revocation of consent must be honored within a reasonable time, not to exceed ten business days.
- Use an autodialer, a prerecorded or artificial voice, or marketing texts only where the consumer's written consent authorizes you to; otherwise, dial by hand.
- Get any consent the law requires before you record a call.
- Use each lead, transfer and appointment only for your own final expense insurance sales, and do not resell or share it.
- Keep the records we deliver secure, and stop using a consumer's record when that consumer asks you to.
Our part is the record. We keep source, timestamp, landing page and consent records for the leads we deliver, and a lead whose consent record cannot be produced where one is required is replaced or credited. Those records support your compliance but do not replace it; read how consent is captured and recorded. We may pause deliveries to a buyer who breaches this section.
No promised outcomes, and limits on liability
We sell leads, transfers, appointments and services, not results. Each product defines what you pay for, such as a transfer that meets all five billing rules or a kept appointment. Beyond its own billing rule, no product promises a contact rate, a number of appointments, sales, issued policies, a cost per lead or a volume.
To the extent the law allows, neither party is liable to the other for lost profits or for indirect, special or consequential damages, and our total liability for any claim about an order is limited to the amount you paid for that order.
Governing law, changes and contact
These terms are governed by the laws of the state in which the business that operates Final Expense Marketing is organized, without regard to its conflict-of-law rules.
We may update these terms by posting a new version on this page. The version in force when you place an order applies to that order.
How we handle the personal information in quote requests and orders is set out in our privacy policy. Questions about these terms go to the email address on our contact page.
